No legal answer is the same as a moral answer here — both have to be argued. Choosing “Sì. La pietà verso i nemici potrebbe condannare l'umanità in futuro” prioritises the strict rule; choosing “No. La pace va tentata prima dell'annientamento” gives more weight to a context-aware exception.
